Lease Agreement

STORAGE SPACE LEASE AGREEMENT

The Storage Space Lease Agreement (the “Lease”) will be made and entered into on today’s date by and between Bath Storage (the “Landlord”) and you (the “Tenant). The lease will remain in effect for twelve months (the “Lease Term”). At the end of the Lease Term, the Storage Lease Agreement shall automatically continue a month-to-month basis. After the initial term, the Landlord or Tenant may end the Storage Lease Agreement by giving the other 30 days prior written notice before the end of any rental period.

A. CONTACT INFORMATION

Tenant agrees to notify Landlord of any changes to contact information by calling (605) 290-3281.

B. RENTAL PROPERTY

The Landlord agrees to rent to the Tenant the desired size storage unit located at 404 2nd Ave W in Bath, South Dakota, which will be referred to in this lease as “Leased Premises”.

C. USE OF PROPERTY

  1. The Tenant agrees to use the Leased Premises exclusively for the storage of personal property, merchandise, supplies or other material owned by the Tenant and for no other use.
  2. Tenant understands, agrees and accepts that except for the general purpose of facility lighting, the use of electricity for food freezers, refrigerators, and other electrical appliances is strictly prohibited.

D. RENT

  1. Your monthly/annual payments will be based on the following cost schedule:
    • 5’x10′ (monthly at $25/mth, annually at $250/yr for year one and $275/yr for all subsequent years)
    • 10’x10′ (monthly at $40/mth, annually at $400/yr for year one and $440/yr for all subsequent years)
    • 10’x15′ (monthly at $45/mth, annually at $450/yr for year one and $495/yr for all subsequent years)
    • 10’x20′ (monthly at $65/mth, annually at $650/yr for year one and $715/yr for all subsequent years)
    • 10’x25′ (monthly at $75/mth, annually at $750/yr for year one and $825/yr for all subsequent years)
    • 10’x30′ (monthly at $90/mth, annually at $900/yr for year one and $990/yr for all subsequent years)
    • 28’x48′ (monthly at $550/mth, annually at $5,500/yr for year one and $6,050 for all subsequent years)
    • 32’x48′ (monthly at $650/mth, annually at $6,500/yr for year one and $7,150 for all subsequent years) plus the cost of electricity
  2. Monthly payments – Your rental payment will be charged to the credit card provided on the same day of the month as your initial payment. If your first payment was made on the 5th, all subsequent payments will be charged on the 5th of the month.
  3. Annual payments – Your annual rental payment will be charged to the credit card provided on the same day each year as your initial payment. If your first payment was made on October 7, all subsequent payments will be made on October 7 the following year.
  4. It is the responsibility of the Tenant to communicate if a change to the credit card to process monthly/annual payments needs to be changed in advance of the payment date to avoid late fees.

E. LATE FEES

  1. If Tenant’s credit card transaction is denied and a new credit card is not provided within five (5) days of the Rent Due Date; Tenant must pay a Late Fee of $20 in addition to the monthly/annual payment.
  2. If Tenant’s credit card transaction is denied three (3) times within a 12-month period this is a default of the lease.
  3. Payments received by the Landlord when there are arrearages shall be credited first to any outstanding balance and then applied to the current amount due.

F. CLEANING DEPOSIT

  1. The Tenant will be responsible for a Cleaning Deposit equal to $40.
  2. The Cleaning Deposit is intended to pay the cost of damages, excessive wear and tear once the Lease has ended and/or for any unpaid charges or attorney fees suffered by the Landlord by reason of the Tenant’s default of this Lease.
  3. Under no circumstances can the Cleaning Deposit be used as payment for rent/or other charges during the term of this Lease.
  4. The property must be left in good, clean condition with all trash, debris and the Tenant’s personal property removed.
  5. The Landlord’s recovery of damages will not be limited to the amount of the Cleaning Deposit.

G. CONDITION OF PROPERTY

  1. Tenant agrees that neither the Landlord nor his agent has made promises regarding the condition of the premises.
  2. Tenant agrees to return the premises to Landlord at end of the lease in the same condition as it was at the beginning of the lease.

H. RULES AND REGULATIONS

  1. Late fees are strictly enforced, and any unpaid fees will not be waived.
  2. The Tenant may not interfere with the peaceful enjoyment of the neighbors.
  3. The Tenant will be responsible for any fine and/or violation that is imposed on the Landlord due to Tenant’s negligence.
  4. The Tenant shall abide by all Federal, State, and Local laws.
  5. The Tenant shall notify the police and Landlord of any illegal activity that is witnessed in or around the Lease Premises.
  6. The Tenant agrees not to use the Leased Premises for any unlawful purpose including but not limited to the sale, use or possession of illegal drugs on or around the Lease Premises.
  7. Absolutely no hazardous materials are permitted to be in or around the Lease Premises at any time.
  8. The Tenant may not use or store kerosene or space heaters at any time in or around the Leased Premises.
  9. Charcoal and Gas Barbeque grills may not be used inside the Leased Premises.
  10. The Tenant may not hang or place signs on or about the Lease Premises.

I. INSURANCE

Tenant agrees to be solely responsible for any damage(s) to or loss of Tenant’s personal property. Landlord is not responsible for any loss or damage due to fire, theft, water, wind, hurricane, or any cause whatsoever to tenant’s property, nor is Landlord required to carry any insurance to cover same. Tenant, at his own expense, shall obtain his own insurance, if any, for the property stored in the Premises.

J. CHANGE OF TERMS

Landlord may change the terms, conditions, rules and regulations and/or addendums by giving O days written notice to tenant

K. LANDLORD’S REMEDIES

  1. If Tenant violates any part of this Lease including non-payment of rent, Tenant is in default of this Lease Agreement.
  2. In the event Tenant fails to pay the rent due under the terms and conditions of this Agreement, Landlord may deny access until the rent and all outstanding charges are paid in full.
  3. Whenever the rent is more than 30 days in arrears, Landlord my remove any property in the storage space and release the premises to the Landlord.
  4. Landlord shall have a lien on any property place in the storage space and shall have the rights to sell the property at public or private sale, or as provided by law.

L. ELECTRONIC SIGNATURES

The use of electronic signatures and electronic records (including, without limitation, any contract or other record created, generated, sent, communicated, received, or stored by electronic means) shall be of the same legal effect, validity and enforceability as a manually executed signature or use of a paper-based record-keeping system to the fullest extent permitted by applicable law.
